OFFICIAL AUCTION TERMS AND CONDITIONS

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY PRIOR TO BIDDING AND BUYING ONLINE AT BOSTONPROSHOP.COM.

The following policies apply to the purchase of items on the Bruins Authentics Online Auction only. Bidders and Bruins Authentics Online Auction agree that the terms listed below shall govern each online auction sale.

To participate in an online auction sale all Bidders must have a registered account with BostonProshop.com and be logged in to participate. All registration information that the Bidder provides to the Bruins Authentics Online Auction shall be current, complete, and accurate. The registration process does not require Bidders to enter credit card information; however, Bidders will be prompted for this information before placing a bid for an item. All Bidders must be 18 years of age or older at the time of bidding. Bidders agree to not use any device, software, or routine to interfere or attempt to interfere with the proper working of or any transaction being conducted on and during an auction sale.

Once a Bidder has registered an account with BostonProshop.com they have the option to participate in the online auction via SMS text bidding. In order to participate in the online auction via SMS text bidding Bidders must activate text bidding on their Bruins Authentics account and then send <Text reference number>;<Bid amount> to 1-989-256-1025 and your bid will be placed.

The auction text reference number can be found on the listing pages. Standard text messaging rates apply. Please note, the country of origin for the Bruins Authentics Online Auction response phone number is the United States of America.

Bruins Authentics Online Auction does not guarantee continual, uninterrupted, or error-free service or use of BostonProShop.com (the “Site”). Bidders acknowledge that each online auction on the Site is conducted electronically, and that online auctions rely on hardware and software that may malfunction without warning. Bruins Authentics Online Auction is not liable to any Bidder or any other person for any interruption in service, malfunction, error, or omission, caused by any means, that may affect the Site.

Bruins Authentics Auction reserves the right to modify, extend, suspend, or terminate an online auction if it determines, in its sole discretion, that the online auction is technically impaired or corrupted or that fraud or technical problems, failures, or malfunctions or other causes beyond Bruins Authentics Auction’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper bidding and/or feasibility of the online auction as contemplated herein and to disqualify any individual who tampers with the bidding process. If for any reason, the online auction is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, and unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Bruins Authentics Auction which corrupt or affect the administration, security, fairness, integrity of the online auction or the bidding process, Bruins Authentics Auction reserves the right in its sole discretion to disqualify any individual it believes has tampered with the bidding process or online auction, and/or cancel, terminate, modify or suspend the online auction.

  1. All items placed for auction will have a minimum bid which the opening bid must exceed by at least $1.00, all subsequent bids must exceed the current highest bid by the dollar increment indicated on the specific auction page.
  1. In order to ensure that you are viewing the current highest bid Bidders must ensure that they are regularly refreshing their screens. In the event that a Bidder places a bid that is lower than the current highest bid such bid will be automatically rejected.
  1. Bidders may set a max bid which is the maximum amount that they are willing to pay for an auction item. Bidders’ max bid is kept confidential until it is exceeded by another bid. The automatic bidding feature will place bids on your behalf in the appropriate dollar increment listed on the auction item above the current competitive highest bid until Bidder’s max bid is reached.
  1. If duplicate max bids are entered for the same auction item, the Bidder who entered the max bid first will get priority.
  1. All bids must contain numbers and decimal points only (i.e. 50.00) entering a dollar sign or comma into the bid amount field will cause a bid to fail to be entered.
  1. No returns or refunds will be accepted. All items are sold as is. No discounts may apply to auction items.
  1. Bidders are only able to retract bids which they claim they made a typographical error when placing. In order to retract a bid Bidders must email a formal request to Authentics@BostonBruins.com within more than 24 hours before the close of the auction in question. Retracting requests must include the item listing number and the reason for the retraction. All bid retraction requests received without a valid explanation will be denied by Bruins Authentics. All bid retraction requests will be accepted or rejected by Bruins Authentics sole discretion.

  1. All auctions will typically be open for bidding for a period of seven (7) to ten (10) days (the “Auction Period”); however, the exact duration will always be at the discretion of the Boston ProShop and Bruins Authentics.
  1. As a Bidder, placing a bid is a binding contract between you and Bruins Authentics Online Auction and the bid cannot be Bidders are encouraged to double check their bid before entering it.
  1. Bruins Authentics Online Auction reserves the right to reject any and all bids in its sole
  1. Bruins Authentics Online Auction is not responsible for any inadvertent failure to execute bids, or for any error in the execution of bids.
  1. At the close of an Auction Period the highest Bidder will be notified via email that they have won the rights to purchase the item as the highest Bidder in that particular The email will provide instructions on how to proceed.
  1. The winning Bidder is responsible for returning to the Bruins Authentics Auctions website to verify that they have won the auction. If winning Bidder does not receive notice and believes they are the winning Bidder, they must verify the auction status from the Manage My Bids>View My Bid Status in the My Auction Account section of the auction website. As a winning Bidder, the primary payment card you have on file will be automatically charged the amount of the winning Bid plus applicable taxes. In the event that the winning Bidder’s credit card is decliened upon purchase the winning bidder will have two (2) business days to complete their payment with a valid credit card. Winning Bidders who will be shipping items to Canada will be charged a $35 fee. Winning Bidders who will be shipping orders outside the US and Canada will be charged a $75 fee.
  1. Once an auction item has been purchased, Bruins Authentics will ship the item to the purchaser at no cost to the purchaser if shipped within the S.. There will be a $35 fee for all Canadian orders, and a $75 fee for all other international orders. Purchaser is responsible for all duties and fees.
  1. Except where prohibited, each Bidder agrees that: (1) any and all disputes, claims and causes of action arising out of or in connection with the Bruins Authentics Online Auction or any item purchased through an online auction as part of the Bruins Authentics Online Auction, without resort to any form of class action, and exclusively by state or federal courts situated in Boston, Massachusetts, (2) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, but in no event attorneys’ fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, “Special Damages”), and (4) Bidders hereby waive all rights to claim Special Damages and all rights to have such damages multiplied or Massachusetts law, without reference to Massachusetts’ choice of law rules, governs the Bruins Authentics Online Auction and all aspects related thereto.
